Sweepstakes Name: Tour of Staged Homes – Guest Sweepstakes

Sweepstakes Registration Period: May 1, 2024, to July 31, 2024

By entering the Tour of Staged Homes – Guest Sweepstakes (the “Sweepstakes”), you agree to be bound by the following terms, provisions, and conditions set forth herein (the “Disclaimer”). Please read the Disclaimer carefully before entering the Sweepstakes. If you do not agree to all the terms, provisions, and conditions of the Disclaimer, then you may not enter the Sweepstakes.

The Experience Furniture, Inc., a South Dakota corporation, its subsidiaries, and affiliated companies (collectively the “Sponsor”), will conduct the Sweepstakes substantially as described herein, and by entering the Sweepstakes, each entrant agrees as follows:

1. How to Enter. The Sweepstakes begins at 12:00 a.m. (CT) May 1, 2024, and ends at 11:59 p.m. (CT) July 31, 2024 (the “Sweepstakes Period”). At each staged home affiliated with Sponsor (an “Affiliated Home”), there will be a box to submit paper entries into the giveaway. Prizes for visiting an Affiliated Home will be awarded based only on drawings from the pool of Valid Entries. A valid paper entry will contain the full name, email address, and phone number of the Eligible Entrant (a “Valid Entry”). At each Affiliated Home that an Eligible Entrant visits during the Tour of Staged Homes, an Eligible Entrant has the option of submitting one Valid Entry for the giveaway. As such, an Eligible Entrant can have a maximum of one Valid Entry into the drawing at each Affiliated Home, but an Eligible Entrant could have a Valid Entry for each Affiliated Home visited. Multiple participants are not permitted to share the same email address. In the event of a dispute regarding the identity of the person submitting a Valid Entry, the Valid Entry will be deemed to be submitted by the authorized account holder in whose name the provided email account is registered. Entries made in any manner not in compliance with the requirements of these Official Rules are invalid and will be disqualified.

2. The Sweepstakes is open to any person meeting all of the following eligibility requirements (an “Eligible Entrant”): (i) legal residents of the 50 United States or District of Columbia; (ii) at least 18 years old as of the date of entry; and (iii) registered in person by filling out an entry form at the Affiliated Home. Void in Puerto Rico, and all other U.S. and foreign territories and possessions, and wherever else prohibited or restricted by law.

3. Drawing. The three (3) Sweepstakes winners will be randomly selected as follows:

• One Sweepstakes winner will be randomly selected from the aggregate of all Valid Entries received from all Affiliated Homes in the month of May 2024. A random drawing shall be conducted within the first week of June 2024 by representatives designated by Sponsor.
• One Sweepstakes winner will be randomly selected from the aggregate of all Valid Entries received from all Affiliated Homes in the month of June 2024. A random drawing shall be conducted within the first week of July 2024 by representatives designated by Sponsor.
• A Sweepstakes winner will be randomly selected from the aggregate of all Valid Entries received from all Affiliated Homes in the month of July 2024. A random drawing shall be conducted within the first week of August 2024 by representatives designated by Sponsor.

Odds of winning depend on number of Valid Entries received during the Sweepstakes Period. Sponsor decisions are final and binding on all matters relating to this Sweepstakes. Potential winners will be notified via email. A winner will have 48 hours to respond back to the prize notification. If a prize notification email is returned or unanswered within the allotted time (48 hours) or if a potential winner declines the prize or is ineligible, an alternate winner will be selected by random drawing of the remaining Valid Entries relating to such drawing. As a condition of awarding the prize: (1) you consent to Sponsor's use of your name for promotional purposes, including posting of the winner's name in a winners list, in social media (such as Twitter® and Facebook®) and via online announcements, without additional compensation, except where prohibited by law, and (2) if requested by Sponsor, the winner is required to sign and return an affidavit of eligibility/publicity and liability release within the time specified by Sponsor. If a winner is ineligible, cannot be contacted, fails to timely return an affidavit/release as specified by Sponsor, declines the prize, or if the prize is returned as undeliverable, an alternate winner will be selected. If, in Sponsor's opinion, there is any suspected or actual evidence of tampering with any portion of the promotion, or if technical difficulties compromise the integrity of the promotion, Sponsor reserves the right to terminate the promotion and conduct a random drawing to award the prizes using all Valid Entries received as of the termination date.

4. Conditions of Entry.  Incomplete entries will not be accepted. All entries become the property of Sponsor. All entries will be submitted as the email of the individual person. Prizes can only be awarded to the person whose name is listed on the account. By participating, Eligible Entrants agree to these Official Rules, including all eligibility requirements. Sponsor reserves the right to disqualify participants who violate these Official Rules or interfere with this Sweepstakes in any manner. If a participant is disqualified, Sponsor reserves the right to terminate that participant's eligibility to participate in the Sweepstakes. This Sweepstakes is subject to all federal, state, and local laws. Neither Sponsor nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission or failures of any network, computer equipment, web site or software, or any other error or malfunction, or late, lost or misdirected entries. Sponsor is not responsible for any liability for damage to any computer system resulting from participation in or accessing or downloading information in connection with this promotion.

5. Prizes. The winners will be awarded the following prizes: $2,000.00 worth of furniture from the Sponsor, awarded via a payment method determined by the Sponsor. PRIZES WILL BE ACCEPTED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE). Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a prize manufacturer that may be sent along with a prize. All taxes, if applicable, are the sole responsibility of the winner. No prize substitution, cash substitution, or assignment or transfer of prizes is permitted, except by Sponsor for reason of unavailability in which case a prize of equal or greater value will be awarded. Odds of winning depend upon the number of Valid Entries received during the Sweepstakes Period. Limit one prize per household. Winners should allow 6 to 8 weeks from notification for delivery of the prizes. The total ARV of all prizes available to be won is $6,000.00. All prizes awarded are subject to verification of eligibility and compliance with these Official Rules.

6. Conditions and Limitations. The Sponsor reserves the right to refuse to award a Prize to a selected winner in the event of noncompliance with the Disclaimer. Winners are subject to a verification process. If a winner is disqualified, the Sponsor reserves the right to determine an alternate winner in its sole and absolute discretion. Only one (1) Prize can be claimed per household for the duration of the Sweepstakes. Employees of the Sponsor, the Sweepstakes’ participating sponsors, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as in-laws or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

7. The Sponsor is not responsible for, and disclaims all liability for, any inability of a potential entrant to complete an entry due to equipment malfunction, internet connection issues, inadvertent disconnections, acts beyond the Sponsor’s control, or any other error, failure or defect of any kind. The Sponsor disclaims all liability for any delays, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. Entries must be made as detailed herein. No photocopies or mechanical reproductions of entry forms are permitted. The Sponsor is not responsible for human, mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including without limitation, failed, incomplete, garbled or delayed transmission of online entries, lost or unavailable network connections which may limit an entrant’s ability to participate in the Sweepstakes, or any injury or damage to entrant’s or any other individual’s computer related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes

8. Publicity; Use of Personal Information. By participating in the Sweepstakes, all entrants and winners grant the Sponsor permission to use their respective name, character, photographs, voice, and likeness in connection with promotion of this and other sweepstakes, and waive any claims to royalty, right, or remuneration for such use. By participating in the Sweepstakes, entrants consent to and agree that the Sponsor may disclose personal information obtained from entrants in the Sweepstakes to Sponsor’s affiliates and third parties and/or use such information for marketing, real estate solicitation, and other purposes on a worldwide basis in perpetuity.

9. Release and Indemnity. By participating in the Sweepstakes, each entrant and winner (i) waives any and all claims of liability against the Sponsor, its parent, related, affiliated and subsidiary companies and the employees and agents of each (collectively, the “Sponsor Released Parties”), the Sweepstakes’ sponsors, and their parent, related, affiliated and subsidiary companies and their respective employees and agents (collectively, the “Sponsor Released Parties,” together with the Sponsor Released Parties, the “Released Parties”), for any loss, claim or cause of action or personal injury which may arise out of the conduct of, or participation in, the Sweepstakes, or from the use of any Prize including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, software applications, mobile devices, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors of any kind in the promotion or administration of the Sweepstakes or the processing of entries; or (f) injury (up to and including death) or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any Prize, including travel, and (ii) agrees to indemnify Released Parties from any and all liability resulting or arising from the Sweepstakes and does hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law. Each entrant further agrees that in the event of any claim, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorneys’ fees. Each entrant waives the right to claim any damages whatsoever, including without limitation, punitive, consequential, direct, or indirect damages.

10. Conduct and Decisions. By participating in the Sweepstakes, entrants agree to be bound by the decisions of Sponsor, which are final and binding. Individuals who violate any rule, gain unfair advantage in participating in the Sweepstakes, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstakes and the Sponsor’s decisions concerning such disputes shall be final and binding. If the conduct or outcome of the Sweepstakes is affected by human error, any mechanical or technical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Sponsor, or if for any other reason the Sponsor determines that the Sweepstakes cannot be run as planned, the Sponsor reserves the right to terminate the Sweepstakes, or make such other decisions regarding the outcome as the Sponsor deems appropriate. The Sponsor may amend and/or waive any of these rules in its sole and absolute discretion.

ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT, OR DAMAGE ORDINARY AND NORMAL OPERATION OF THE SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPATION TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Winners will be announced on the Facebook page for Sponsor.

12. Compliance with Law. The conduct of the Sweepstakes is governed by and shall be construed in accordance with the laws of the State of South Dakota, without reference to any conflict or choice of law provisions. The parties hereby consent to the personal jurisdiction of the federal and state courts in the State of South Dakota, waive any argument that such forum is not convenient, and agree that any litigation relating to the Sweepstakes or the subject matter hereof shall be venued in either the Circuit Court in Minnehaha County, South Dakota, or the Federal District Court, District of South Dakota, Southern Division.

The parties hereby consent to the personal jurisdiction of the federal and state courts in the State of South Dakota, waive any argument that such forum is not convenient, and agree that any litigation relating to the Sweepstakes or the subject matter hereof shall be venued in either the Circuit Court in Minnehaha County, South Dakota, or the Federal District Court, District of South Dakota, Southern Division.
