Terms & Conditions

The following Terms and Conditions (“Terms”) govern participation in the HomeStart Credit Program (“Program”). By participating in the Program, tenant acknowledges and agrees to be bound by these Terms in full.

• The Program is only available to tenants of properties managed by The Experience Rentals who subsequently purchase a home using an agent affiliated with The Experience Real Estate as their exclusive buyer’s agent. Program credits may only be redeemed in connection with a qualifying home purchase closed through The Experience Real Estate.
• The Program is based solely on the total amount of base rent actually paid by the tenant during the period in which The Experience Rentals has actively managed the property.
• To be eligible for the Program, tenant must be current on all rent and other financial obligations and otherwise not in default of its lease to participate in the Program. Any tenant subject to an eviction, early termination, or tenant-initiated lease break shall not be eligible for the Program.
• The Program shall not apply to any property subject to a lease-to-purchase or rent-to-own program.
• The maximum benefit that may be earned for any single property under the Program shall not exceed Three Thousand Dollars ($3,000), regardless of duration of tenancy or total rent paid.
• In no event shall the Program benefit exceed thirty percent (30%) of the buyer agent’s commission in connection with the Participant’s qualifying home purchase transaction.
• The Program benefits are promotional credits only. Program credits cannot be redeemed for cash, refunded, transferred, or applied toward any rental payments, past due balances, fees, or other charges. Program credit may not be pledged, assigned, or otherwise transferred without the prior written consent of The Experience Rentals.
• Program credit may be adjusted, reduced, or reallocated in the event of any change in household composition. If a financially responsible leaseholder vacates the property, Program credit shall be allocated exclusively among the remaining financially responsible leaseholders. Co-signers or guarantors are not eligible to receive any benefits hereunder.
• If tenant vacates its rental property, any accrued Program credits must be redeemed within twelve (12) months of the vacation date. Program credits not redeemed within this timeframe shall expire.
• The Experience Rentals reserves the right, in its sole discretion, to modify, suspend, or terminate the Program, in whole or in part, at any time for any or no reason. The Experience Rentals may modify these Terms, in whole or in part, following thirty (30) days’ written notice tenants.
• The Experience Rentals shall have sole authority to interpret these Terms and determine eligibility, credit calculations, and allocations. All such determinations shall be final and binding.
• Participation in the Program does not create any contractual right to continued tenancy, property management services, brokerage services, or any future benefits beyond those expressly stated herein.
• These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, without regard to conflict-of-law principles.
